Summary of Legislative / Policy Change
In April 2022, the APNIFFT Coordinator, Mr. Rodgers Kidiya and the steering committee members supported in the design and review of the Southern African Development Community (SADC) Public Finance Management (PFM) model law. The model law was unanimously https://www.parliament.gov.za/news/sadc-pf-sets-out-enact-model-law-public-finance-management-region approved by the 51st Plenary Assembly of the SADC Parliamentary Forum on 14th July 2022. The law will serve as a benchmark and guiding legal instrument for national Parliaments to reinforce their domestic legal framework on public financial management. The Model Law will be incorporated by SADC Member States through amendments conducted to the Constitution, finance laws, regulations or the Standing Orders and Rules of the National Assembly, as may be necessary

• A report by Transparency International on the extractive sector in Cameroon had indicated that the country has vast amounts of mineral resources both in quantity and variety.
• Unfortunately, though much of it is exploited, little is known about the impact of the revenue from the extractive industry to the development of this country be it in the sectors of education, health, road infrastructure. Et al

APNIFFT members introduced a mining bill amending the mining code in Burundi was passed. The bill brought in a raft of measures within the mining industry in Burundi, among them developing good governance within the mining sector in Burundi besides creating a regulatory framework that balances the interests of investors, local communities, and the environment, while maximizing the socioeconomic benefits derived from the country’s mineral resources.

DRC Success Story

In February 2024, the DRC government rectified a controversial mining deal with Chinese mining companies, providing specific obligations to the companies in taxes and supporting local communities. A motion was moved and adopted in Parliament that requires all MNCs wanting to mine in the country to first obtain approval from the Parliament mining committee and the Ministry of Mining. Two MPs in DRC openly denounced an unplanned and unreviewed mineral contract that the country had developed. This led to the rectification of the of controversial mining deals the Congolese government had with the Chinese government who had been accused of mining critical metals from DRC without being compelled to give back to local communities.

Amendment of the Treaty Making and Ratification Act and review of parliamentary standing orders in Kenya.

TJNA and Econews supported the Kenyan APNIFFT members worked on the documented several issues with the law:
• The lack of Parliament’s (both National Assembly and Senate) involvement in the initiation of the processes to determine relevance and need of the treaty;
• Parliament is not involved in the negotiation process; and
• Parliament debates the Treaty but has no powers to amend it or propose amendments. This had created a loophole for corrupt deals by the executive especially with Economic Partnership Agreements and Double Tax Agreements.
The Kenyan APNIFFT members worked on the amendment and pushed it on the floor of parliament to the committee stage by end of 2022.

The APNIFFT caucus in Kenya working with TJNA achieved a great milestone after Kenya ratified the Multilateral Convention (MLI) to implement tax treaty-related measures to prevent Base Erosion and Profit Shifting (BEPS). The ratification of the MLI was a key measure required to assist Kenya address aggressive tax avoidance schemes by multinationals. TJNA provided a briefing to the departmental committee on finance and national planning as well as the APNIFFT caucus and the members were instrumental in pushing for the ratification of the MLI.

Liberia Success Story

Launch of the Liberian National caucus. From October 2021 to September 2021, the caucus has embarked on the following activities. Firstly, it developed a red flag memo as a benchmark for the passage of a mining concession which led to the delay in the passage of Bao-CHICO mineral concession
Secondly, the caucus championed the passage of legislations dealing with DRM which included:the amendment of the Public Financial Management Act, amendment of the Liberia Revenue Code Act of 2011, and the enactment of Revenue Sharing law to support local government. It also championed those with respect of IFFs, such as the amendment of Anti-Corruption Act and Creation of the Liberia Anti-Corruption Agency which grants it the power to prosecute corruption cases in a fast-tracked manner, the enactment of the Financial Intelligence Agency Act, and the Anti-money laundering, terrorist financing, preventive measures, and proceeds of Crimes Act, and finally, the enactment of Witness Protection Act of 2021, and the Whistleblower Act of 2021.

This resulted from IWL’s research highlighting untapped revenue sources, such as sand mining and excessive tax incentives for multinational corporations. The findings were presented to the Legislature’s Budget Committee and APNIFFT Caucus, leading to policy reforms and a subsequent investigation by the General Auditing Commission (GAC) into revenue losses in the sand mining sector.

• According to research on tax leakages in Tanzania , between 2013 and 2020, the cumulative effect of internal inefficiencies, tax evasion, harmful tax incentives, double taxation agreements and illicit financial flows had resulted in estimated losses of around TZS 17.4 trillion (around US$ 7.6 billion) per annum. This amount, is almost equal to the country’s entire annual tax collection for 2020/21.
• The APNIFFT members, led by Hon. Cecilia Pareso, raised a motion on 1st February 2022 highlighting these issues and providing solutions summarized in the report.

Following March 2023, following a detailed report by the Bujagali Ad Hoc Committee, the Ugandan Parliament—guided by input from the caucus—suspended a proposed five-year corporate tax waiver extension for BBujagali Energy Limited. Instead, a one-year extension was granted, allowing time for further scrutiny.
As a result in 2024, MPS stopped the extension of Tax waivers to Bujagali energy in Uganda.

Following the 2021 Annual APNIFFT Continental Conference held in Dakar, Senegal (convened in September 2022), Hon. Oguzu, a 38-year-old first-time Member of Parliament representing Maracha East constituency in Uganda’s West Nile region, was inspired by the knowledge and capacity gained during the meeting to take legislative action. The conference, which focused on strengthening parliamentary engagement on Illicit Financial Flows (IFFs) and Domestic Resource Mobilisation (DRM), equipped him with the tools and insights needed to drive national dialogue on tax justice. As a direct outcome, he tabled a motion in parliament addressing IFFs and DRM, citing Uganda’s estimated annual loss of $382.8 million to tax havens and its contribution to global tax losses of $114.4 million—bringing critical attention to the urgent need for reform.

Introduction of sin tax in Zambia (tobacco). This includes aligning excise taxes, such as those on tobacco products (sin taxes), to prevent tax rate disparities that could lead to smuggling or market distortions hence increase in domestic resource mobilization. Overall, this has contributed immensely towards harmonization within RECs by aligning tax policies and incentives to create a more conducive business environment and reduce distortions in cross-border trade hence increasing Zambia’s revenue.

Amendment of the Treaty Making and Ratification Act and review of parliamentary standing orders in Kenya.

TJNA and Econews supported the Kenyan APNIFFT members worked on the documented several issues with the law:
• The lack of Parliament’s (both National Assembly and Senate) involvement in the initiation of the processes to determine relevance and need of the treaty;
• Parliament is not involved in the negotiation process; and
• Parliament debates the Treaty but has no powers to amend it or propose amendments. This had created a loophole for corrupt deals by the executive especially with Economic Partnership Agreements and Double Tax Agreements.
The Kenyan APNIFFT members worked on the amendment and pushed it on the floor of parliament to the committee stage by end of 2022.

The APNIFFT caucus in Kenya working with TJNA achieved a great milestone after Kenya ratified the Multilateral Convention (MLI) to implement tax treaty-related measures to prevent Base Erosion and Profit Shifting (BEPS). The ratification of the MLI was a key measure required to assist Kenya address aggressive tax avoidance schemes by multinationals. TJNA provided a briefing to the departmental committee on finance and national planning as well as the APNIFFT caucus and the members were instrumental in pushing for the ratification of the MLI.

Motion without notice on ‘Tax Revenue Leakages in Tanzania
Evidence
• According to research on tax leakages in Tanzania , between 2013 and 2020, the cumulative effect of internal inefficiencies, tax evasion, harmful tax incentives, double taxation agreements and illicit financial flows had resulted in estimated losses of around TZS 17.4 trillion (around US$ 7.6 billion) per annum. This amount, is almost equal to the country’s entire annual tax collection for 2020/21.
• The APNIFFT members, led by Hon. Cecilia Pareso, raised a motion on 1st February 2022 highlighting these issues and providing solutions summarized in the report.

Following March 2023, following a detailed report by the Bujagali Ad Hoc Committee, the Ugandan Parliament—guided by input from the caucus—suspended a proposed five-year corporate tax waiver extension for BBujagali Energy Limited. Instead, a one-year extension was granted, allowing time for further scrutiny.
As a result in 2024, MPS stopped the extension of Tax waivers to Bujagali energy in Uganda.

DRC Success Story

In February 2024, the DRC government rectified a controversial mining deal with Chinese mining companies, providing specific obligations to the companies in taxes and supporting local communities. A motion was moved and adopted in Parliament that requires all MNCs wanting to mine in the country to first obtain approval from the Parliament mining committee and the Ministry of Mining. Two MPs in DRC openly denounced an unplanned and unreviewed mineral contract that the country had developed. This led to the rectification of the of controversial mining deals the Congolese government had with the Chinese government who had been accused of mining critical metals from DRC without being compelled to give back to local communities.
